Terms of Use.

1. Acceptance of Terms and Modifications

By downloading, accessing, or using the TellKin application ("Service"), you agree to these Terms. We reserve the right to modify these Terms at any time. Your continued use of the Service after changes constitutes your acceptance. You must be at least 18 years old to create an account. If you add information about minors to your family tree, you represent and warrant that you are their parent or legal guardian, assuming full legal responsibility.

2. Account Security

You are responsible for maintaining the confidentiality of your account credentials. Moonlight Agents Ltd is not liable for any loss arising from your failure to protect your login information or device.

3. Controlling Language

The English language version of these Terms shall govern your relationship with us, and any inconsistencies in translations will be resolved in favor of the English version.

4. App Store / Platform Disclaimer

You acknowledge that these Terms are concluded between you and Moonlight Agents Ltd only, and not with Apple Inc. or Google LLC (collectively, "Platform Providers"). Platforms are not responsible for the Service, its maintenance, support, or content. To the maximum extent permitted by applicable law, Platform Providers will have no warranty obligation whatsoever with respect to the Service. Any claims relating to the product, intellectual property, or compliance are the sole responsibility of Moonlight Agents Ltd. You agree that Platform Providers and their subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

5. Acceptable Use, Deepfakes, and Web Security

You are strictly prohibited from: (a) reverse-engineering the App or web platform; (b) using bots, spiders, or automated scripts to interact with our AI APIs or to scrape content from the Service; (c) attempting to extract system prompts or bypass security measures. Furthermore, you are strictly prohibited from uploading synthetic or cloned voice recordings (deepfakes) to impersonate individuals or create fabricated records. Violation results in an immediate ban and termination of access to the Service.

6. User-Generated Content (UGC), Moderation, and Zero Tolerance

We maintain a zero-tolerance policy for objectionable or abusive content. Users are strictly prohibited from uploading content that is illegal, defamatory, or offensive. The Service provides built-in mechanisms allowing users to report inappropriate content and block any other users from interacting or sharing trees with them. Users can also report violations via policy@tellkin.app. We will investigate and act upon reports within 24 hours. We reserve the right to remove User Content and ban users immediately without prior notice.

7. Sensitive Data and Family Disputes

You must obtain explicit consent before uploading sensitive data (health, religion, etc.) about living individuals. In case of disputes between family members regarding the content of a shared tree, the Owner/Administrator of the tree has the final say, but Moonlight Agents Ltd reserves the right to hide content until the dispute is resolved.

8. AI Disclaimer, Accuracy, and Medical/Legal Info

The Service uses AI (e.g., OpenAI, Anthropic, Google) to generate text. YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS. YOU ASSUME FULL RESPONSIBILITY FOR FACT-CHECKING AI-GENERATED TEXT. The Service is provided for informational and entertainment purposes only. TellKin does not provide medical, legal, or official genealogical evidence. We disclaim all liability for any actions taken based on AI-generated content, including legal proceedings or citizenship applications.

9. User Consents and Export Responsibility

By adding individuals to your tree, you warrant that you have obtained their explicit consent. If you export data, you assume full responsibility for its security outside of the Service.

10. Ownership and AI Disclosure

Your Content: You retain ownership of your original audio, photos, and data.

AI Output: You have the right to use and export the biographical text. You acknowledge that all content generated by TellKin is identified as AI-assisted. You agree not to remove or obscure any AI-generation disclosures provided within the Service.

11. Account Deletion and Termination

Account deletion includes all associated records in third-party processing services. You may initiate account deletion through the App settings. To preserve family history, we will only delete inactive accounts after ten (10) years of continuous inactivity, following an email notification.

12. Subscriptions, In-App Purchases, and Refund Policy

The Service offers auto-renewable subscriptions. Payment will be charged to your Apple ID (App Store) or Google Account (Google Play) at confirmation of purchase. Subscriptions automatically renew at the same price and duration unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

ALL PURCHASES ARE FINAL. Moonlight Agents Ltd does not process refunds directly. To manage, change, or cancel your subscription, or request a refund, you must use the official subscription settings within your respective store: Apple App Store or Google Play. Uninstalling the app does not automatically cancel the subscription. Exception applies where required by local laws (e.g., 14-day cooling-off periods in the EU/UK).

13. Assignment and Modifications

Moonlight Agents Ltd may assign its rights under these Terms in connection with a merger or sale. We reserve the right to modify or discontinue the Service at any time.

14. Limitation of Liability and Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOONLIGHT AGENTS LTD'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE USE OF THE SERVICE SHALL BE LIMITED TO THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR £1, WHICHEVER IS GREATER. We do not guarantee that data will never be lost. Users are encouraged to regularly export their family data. You agree to indemnify Moonlight Agents Ltd from any claims arising from your User Content or violation of these Terms.

15. Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of London, England.
